CANDYKING SOCIAL MEDIA CHRISTMAS CALENDAR 2024

Read these terms and conditions carefully before participating. The campaign is only valid under the conditions stated here. These terms and conditions and Cloetta’s privacy policy prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry instructions are deemed to form part of the terms and conditions and by participating, all entrants will be deemed to have accepted and be bound by the terms and conditions. Please retain a copy for your information.

Information and terms provided in social media posts part of this campaign shall be considered part of these terms and conditions, unless contradicting to these terms.

About the campaign and Promotional Period

As part of Cloetta Group and/or owner and proprietor of the CandyKing business and trademarks, the campaign is promoted and sponsored by Cloetta UK Limited, Fort Southwick, James Callaghan Drive, Fareham, Hampshire, PO17 6AR.

The promotion will run from:  

Monday 2nd December till Sunday 8th December 2024

Thursday 12th December till Sunday 15th December 2024

Thursday 19th December till Sunday 22nd December 2024

Any entries received outside the promotional period will not be accepted.

Requirements and Eligibility

This campaign is open to;

  • a) UK residents with a postal address within the UK,
  • b) aged 18 or over,
  • c) those who have a registered account on Instagram,
  • d) those who follow CandyKing UK’s account on Instagram,
  • e) excluding employees and the immediate families of the Promoter, its subsidiaries, other group companies, its agents, or anyone else professionally connected with this promotion.

Competition entries can be made on Instagram by following the instructions listed in the Instagram competition post. Entrants must also follow Candyking on their chosen channel of entry. Internet access and a registered account required. No purchase required.

You enter the campaign by following the instructions listed in the social media platform campaign post. The campaign posts will be posted on brand’s social media platform account https://www.instagram.com/candykinguk/ between on the following campaign days:

In order to enter the draw, the participant must follow CandyKing UK’s Instagram account and comment on the campaign post in accordance with the instruction on that particular campaign day.

Each participant is entitled to submit one (1) comment to the campaign post as an entry to the campaign.

All valid entries will be entered into the corresponding daily draw. No purchase requirement.

During the term of the campaign, you can participate in each daily prize draw. Max one (1) entry per person per day.

Entrants who make an entry on someone else’s behalf or using several or fake accounts will be disqualified, at the Promoter’s discretion. Entries (bulk or otherwise) made from trade, syndicates, consumer groups or third parties will not be accepted. If it becomes apparent that a participant is reposting the same content multiple times or using a computer(s) to circumvent this or any other condition by, for example, the use of ‘script’, ‘brute force’ or any other automated means, that person’s entries will be disqualified and any prize award will be void. Incomplete, illegible, invalid or misdirected entries will not be accepted. Proof of sending will not be accepted as proof of delivery. The Promoter takes no responsibility for entries delayed, incomplete or lost due to technical reasons or otherwise.

Winning a Prize

The prizes will be specified and described in the campaign post on the social media platform each campaign day. The prize will be different each campaign day, and the participant only has a chance to win the prize of the particular campaign day or days the participant chooses to participate.

The total amount of winners is also stated in the campaign post separately for each campaign day. All winners will be randomly selected among all participants who meet these conditions each campaign day.

The winners will be announced by CandyKing commenting on the randomly selected winning post under the particular campaign post. The winners will have to claim the prize by contacting CandyKing in a direct message on the social media platform within 14 days from the date when CandyKing will comment on the winning post.

The direct message must contain contact information for the distribution of the prize:

  • a) full first and last name 
  • b) postal address, 
  • c) email address and  
  • d) phone number 

If the winner does not send the message in time or does not provide the contact information above the prize is forfeit and can no longer be claimed by the winner and no further winners of that particular prize will be drawn for that campaign day.

If needed, CandyKing will contact you via the provided email address in order to distribute the prize.

Receiving Prizes

No cash or other alternative prize will be provided in whole or in part, except that in the event of circumstances outside of its control the Promoter reserves the right to substitute a similar prize of equal or greater value. The prizes are non-transferable.

The participant is responsible to pay any taxes should that be applicable to the winnings.

In order to claim their prize, winners are required to submit a valid email address, to which the prize shall be sent, within 14 days of initial contact. County of residence will be requested for the purpose of the winners list if no objection is received.

In the case that they do not respond in time, reject the prize or are ineligible another winner will be selected using the same methodology as above. The process will repeat once for each prize after which any remaining prizes will be null and void. Entrants are encouraged to monitor their connections during this time in case they are a winner.

Prizes will be delivered within 28 days of prize claim and the completion of the verification process. It is the winner’s responsibility to make sure that delivery of the prize is possible, and to pick up the shipment from a collection point. The winner is also responsible for any additional costs in case of a failed delivery or if the shipment is returned to sender due to the winner’s failure to pick it up from collection point. No prizes will be shipped to addresses outside of UK boarders.

GENERAL INFORMATION

PUBLICITY

Winners may be requested but are not obliged to take part in reasonable publicity in connection with this promotion. This may include a request to use the winner’s name and image in connection with such publicity.

WINNERS LIST

The Promoter will make available a list of winners’ surnames and counties of residence to members of the public or regulators who request such details within 3 months of the closing date of this promotion. Entrants can object to disclosure, or request that disclosure be limited in scope by contacting CandyKing-Campaign@cloetta.com. We may nevertheless disclose the information to the Advertising Standards Authority if required to do so. You may request a copy of the winners list by emailing CandyKing-Campaign@cloetta.com. The Promoter reserves the right to refuse such requests.

VERIFICATION

The Promoter reserves the right to verify all entries including but not limited to asking for proof of purchase and ID (passport, driving licence or equivalent). The Promoter reserves the right to refuse to award a prize or withdraw prize entitlement and/or refuse further participation in the promotion and disqualify the participant where there are reasonable grounds to believe there has been a breach of these terms and conditions, the spirit of the promotion, any instructions forming part of this promotion’s entry requirements or otherwise where a participant has gained unfair advantage in participating or won using fraudulent means. It is the responsibility of the entrant to provide correct, up-to-date details when entering the promotion and on prize acceptance.  The Promoter cannot be held responsible for winners failing to supply accurate information which affects prize acceptance or delivery of their prize.

LIABILITY

If for any reason any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, traffic congestion, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter may in its sole discretion modify or suspend the promotion or invalidate any affected entries.

If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms and Conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligation but will always endeavour to minimise the effect to participants in order to avoid undue disappointment.

The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion, the fulfilment of the prizes and/or the use of the prizes, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.

The Promoter has no control over internet or communication networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter will not be held liable to any individual for any fraud committed by any third party nor for any event beyond its control including, but not limited to, user error and any network, computer, hardware or software failures of any kind which may restrict, delay or prevent a participant’s entry to the promotion.

The social media platform on which this campaign is hosted is not affiliated with, endorsing, responsible for or liable for the campaign.

If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these terms and conditions and the remaining clauses shall survive and remain in full force and effect.

The Promoter’s decision is final with regard to all promotional matters and no correspondence will be entered into.

These terms and conditions (and any non-contractual issues which arise out of or in connection with them) will be governed by relevant local law with any disputes as to the meaning of these terms and conditions subject to the exclusive jurisdiction of the English and Welsh courts unless you live in Scotland, in which case your local courts will have jurisdiction.

COMPLAINTS

If you have any complaints, please contact CandyKing-Campaign@cloetta.com. In the event of a dispute over the rules, conduct, results, and any other matters relating to the contest, the Promotor’s decision will be final.

DATA PROTECTION

The Promoter will only use the personal details supplied for the administration of the promotion and for no other purpose, unless we have your consent. Your personal details will at all times be kept confidential and in accordance with current Data Protection legislation.
